Return Policy:

1. An RMA number must be obtained prior to returning any product.

2. The RMA number must be clearly marked on the outside & inside of the return package.

3. PWR Lighting is not responsible for products returned without a valid RMA number.

4. All returned products must be in original packaging with all accessories.

‍1. Definitions

In these General Terms and Conditions:
Customer: the party purchasing products from PWR Lighting.
‍Products: lighting fixtures and related goods offered by PWR Lighting.
‍Agreement: any contract or order confirmed by PWR Lighting.

2. Applicability
‍
These General Terms and Conditions apply to all quotations, offers, deliveries, and agreements between PWR Lighting and the Customer.
The Customer’s general terms are excluded unless explicitly accepted in writing by PWR Lighting.
Acceptance of any quotation or delivery implies full acceptance of these Terms.

3. Offer and Acceptance

All offers and quotations are non-binding and valid for thirty (30) days unless stated otherwise.
PWR Lighting may adjust prices by up to 12.5% in case of unforeseen circumstances, even after order confirmation.
An Agreement is formed only upon written confirmation by PWR Lighting.

4. Prices and Payment Terms

50% of the total order amount must be paid at order confirmation.50% must be paid before shipment to the Customer.Full payment must be made within thirty (30) days from invoice date.Shipment will occur only after full payment is received.
Late payments incur:1% interest per month; and15% fixed penalty (minimum €50).No offsetting or suspension of payment is allowed.

5. Delivery and Transfer of Risk

Delivery times are indicative.
Delays do not entitle the Customer to compensation or cancellation.
Risk transfers to the Customer upon delivery.

6. Retention of Title

Delivered Products remain the property of PWR Lighting until full payment is received.
The Customer must insure the Products during the retention period.
PWR Lighting may reclaim goods without court intervention if payment defaults.

7. Warranty

PWR Lighting warrants its Products against defects in materials and workmanship under normal use for two (2) years.The warranty covers:Repair or replacement of defective Products.Exclusions:Normal wear and tear, misuse, improper installation, unauthorized modifications, exposure to unsuitable conditions.Warranty claims must be submitted to help@pwr-lighting.com within eight (8) days of discovering the defect.
Warranty is valid only if Products are professionally installed according to PWR Lighting’s instructions.

8. Return Policy

Returns require prior written approval. Conditions:Return request within 14 days of delivery.Products unused, undamaged, in original packaging.20% restocking fee applies.Custom-made Products are non-returnable unless defective.
Return shipment costs are the Customer’s responsibility.

9. Force Majeure
‍
PWR Lighting is not liable for failures due to causes beyond its control, such as:Acts of God, war, pandemics, strikes, transport disruptions, supplier failures.In such cases, PWR Lighting may suspend or terminate the Agreement without liability.

10. Limitation of Liability
‍
PWR Lighting is liable only for direct damages caused by defects.
PWR Lighting is not liable for:Indirect, special, or consequential damages, such as loss of profits or reputational damage.Liability is capped at the invoiced amount of the defective Products.

11. Installation
Disclaimer
Products must be installed according to PWR Lighting’s instructions.
Warranty is void if:Installed improperly or by uncertified personnel.PWR Lighting is not liable for damages due to incorrect installation.

12. Intellectual Property
‍
All intellectual property rights to designs, drawings, technical documentation, and materials remain solely with PWR Lighting.
The Customer may not reproduce or distribute any materials without prior written consent.

13. Custom-Made Products
‍
Products manufactured to Customer specifications (special colors, sizes, voltage adaptations) are non-returnable and non-refundable, except in case of manufacturing defects.

14. Data Protection (GDPR)

PWR Lighting processes personal data in compliance with the GDPR.

15. Complaints

Visible defects must be reported in writing within eight (8) days of receipt.
Complaints do not suspend payment obligations.

16. Applicable Law and Jurisdiction

All Agreements with PWR Lighting are governed by Belgian law.
Only the courts of Brussels have jurisdiction in case of a dispute.

17. Severability
‍
If any provision of these Terms is invalid, the remaining provisions shall remain fully effective.
